These Terms and Conditions ("Terms") are a binding agreement between you and Amanda Lifestyle ("Amanda Lifestyle," "we," "us," or "our") governing your use of amandalifestyle.com, join.amandalifestyle.com, and any program, membership, class, challenge, coaching service, or digital product we offer, including Stronger Than 40 and the 3 Day Live Workout Master Class.

By purchasing, registering, or using any of our programs or websites, you agree to these Terms. If you do not agree, do not use our services.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to purchase or register for any of our programs. By signing up, you confirm that you meet these requirements and that the information you provide is accurate and complete.

Medical Disclaimer And Assumption Of Risk

Read this section carefully. It is important.

Amanda Lifestyle provides fitness, nutrition, and mindset education and coaching. We are not doctors, dietitians, physical therapists, psychologists, or licensed medical providers. Nothing we provide is medical advice, diagnosis, or treatment, and nothing we provide is a substitute for care from a qualified healthcare professional.

You should consult your physician before beginning any exercise or nutrition program, especially if you are pregnant or nursing, have or suspect you have a medical condition, are recovering from injury or surgery, or are taking medication. If you experience pain, dizziness, shortness of breath, or any other symptom during exercise, stop immediately and seek medical attention.

Exercise carries an inherent risk of injury. By participating in any Amanda Lifestyle program, you voluntarily assume all risk of injury, illness, or loss arising from your participation, and you agree that you participate at your own risk. You are responsible for exercising within your own limits and for using proper form and appropriate equipment.

No Guarantee Of Results

Results vary from person to person and depend on your starting point, consistency, effort, genetics, health status, sleep, stress, and many other factors outside our control. Testimonials, before-and-after photos, and success stories shown on our websites and in our materials reflect the experiences of specific individuals and are not a promise, guarantee, or typical result. We do not guarantee any specific outcome, weight change, body composition change, or performance improvement.

Membership Plans And Billing

Stronger Than 40 is offered on the following plans:

Month-to-Month Plan: 247.00 US dollars per month

Annual Plan (Paid In Full): 2,497.00 US dollars per year

Prices are in United States dollars and are exclusive of any applicable taxes. We may change our prices at any time. If we change the price of a plan you are already enrolled in, we will notify you by email at least thirty (30) days before the change takes effect, and the new price will apply from your next renewal.

AUTOMATIC RENEWAL. Both plans renew automatically. Your payment method is charged at the time you enroll and then automatically on each renewal date, monthly for the Month-to-Month Plan and annually for the Annual Plan, until you cancel. By enrolling, you authorize us and our payment processor to charge your payment method on a recurring basis.

You are responsible for keeping a valid payment method on file. If a payment fails, we may retry the charge and may suspend or terminate your access until payment is successfully processed.

Cancellation

You may cancel your membership at any time by emailing info@amandalifestyle.com or by using the cancellation option in your member portal, if available.

Cancellation takes effect at the end of your current billing period. You will keep access to the program through the end of the period you have already paid for, and you will not be charged again after that.

Cancelling does not automatically produce a refund of amounts already charged, except as described in the Refund Policy below.

Seven Day Cancellation And Refund Window

Your payment method is charged at the time you enroll. If you cancel within seven (7) days of your initial enrollment, you may request a refund of your initial payment, less any non-refundable payment processing fees charged by our payment processor on that transaction. To request it, email info@amandalifestyle.com within that seven-day window and state that you are cancelling and requesting a refund. Refunds are issued to the original payment method and typically post within five to ten business days, depending on your bank or card issuer.

After the seven-day window, all payments are final and non-refundable, including partial billing periods and unused portions of a plan. Renewal payments are non-refundable.

We may decline a refund request where we reasonably determine there has been abuse of this policy, including repeat enrollment and refund cycles or bulk downloading of program materials followed by a refund request.

Digital Products And One-Time Purchases

Digital products, downloads, and one-time purchases are non-refundable once access has been delivered, unless required otherwise by law.

Free Classes And Challenges

Free classes, challenges, and master classes, including the 3 Day Live Workout Master Class, are provided at no cost. Registering for a free event does not create a paid subscription and does not obligate you to purchase anything. We may record live sessions and make replays available. Scheduled dates and times may change, and we will notify registrants by email if they do.

Member Portal Access And Account Security

Your membership grants you a personal, limited, non-exclusive, non-transferable, revocable license to access program materials for your own personal, non-commercial use while your membership is active.

Your login credentials are for you alone. You may not share, sell, transfer, or allow anyone else to use your account. We may suspend or terminate accounts that appear to be shared. You are responsible for keeping your credentials confidential and for all activity under your account.

Intellectual Property

All program content, including workout programs, videos, lessons, PDFs, meal guidance, graphics, text, branding, and the Stronger Than 40 and Amanda Lifestyle names and logos, is owned by Amanda Lifestyle or its licensors and is protected by copyright, trademark, and other laws.

You may not copy, record, screenshot for distribution, download other than as expressly permitted, republish, resell, distribute, publicly display, or create derivative works from our content, and you may not use it to build or deliver a competing program. Violation may result in immediate termination without refund and in legal action.

Community And Member Conduct

If your membership includes access to a private community, group, or comment area, you agree to be respectful and constructive and not to harass, threaten, demean, or discriminate against other members, spam or solicit other members, share other members' personal information, photos, or stories outside the group, or give medical advice to other members.

We may remove content and remove or ban members who violate these standards, at our discretion and without refund.

Your Content

If you post photos, progress updates, testimonials, or other content in our community or send them to us, you grant Amanda Lifestyle a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content to operate and promote our programs. You can withdraw this permission for future use at any time by emailing info@amandalifestyle.com. We will not use your before-and-after photos in paid advertising without asking you first.

Communications Consent

By providing your email address and phone number, you consent to receive communications from us as described in our Privacy Policy, including program emails, class reminders, and marketing messages. You can opt out of marketing at any time. Transactional messages about your account and access will continue while your membership is active.

Third-Party Services

We use third-party providers for payment processing, hosting, email and text delivery, and community and portal access. Your use of those services may also be governed by their own terms. We are not responsible for the acts or omissions of third-party providers.

Termination By Us

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if your payment fails, if you engage in fraud or abuse, or if we discontinue a program. If we discontinue a program you have prepaid for, we will refund the unused portion on a pro-rata basis.

Disclaimer Of Warranties

Our websites, programs, and materials are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

Limitation Of Liability

To the fullest extent permitted by law, Amanda Lifestyle and its owner, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of our websites, programs, or materials, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or our services will not exceed the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Amanda Lifestyle and its owner, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of our services, your violation of these Terms, or your violation of the rights of any third party.

Governing Law And Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to first contact us at info@amandalifestyle.com and attempt to resolve the dispute informally in good faith for at least thirty (30) days.

Changes To These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. Material changes affecting your membership or billing will be communicated by email at least thirty (30) days in advance. Continuing to use our services after an update means you accept the revised Terms.

Severability And Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and Amanda Lifestyle regarding our services.
